Z przyjemnością informuję, że w I semestrze  roku akademickiego 2022/2023 będziemy gościć w Zakładzie Postępowania Cywilnego w ramach programu „Visiting Professor” Panią prof. dr hab. hab. Tatjanę Zoroską Kamilovską. Pani Profesor jest wybitnym specjalistą z zakresu europejskiego i macedońskiego postępowania cywilnego. Opis:

As a separate and vital branch of legal research and jurisprudence, the comparison of legal systems, including civil procedure as a part of it, has become more important and relevant nowadays. It can not be expected that in the era of globalization, the separate fields of law can base their knowledge exclusively on national ideas and rules.

The general question to be answered within this course is: How close are the civil procedures of the two countries (Poland and North Macedonia) in relation to their origin, evolution and particularly their recent development in the context of current processes of harmonization of the rules on civil procedure?

Within the course, in order to answer this question, several subtopics will be successively considered: the organization of Polish and Macedonian judiciary, the historical perspective of Polish and Macedonian civil procedure, their reforms and contemporary features. All three parts of civil procedure (litigation, non-litigious and enforcement procedure) will be analyzed separately and crosswise, from both normative and practical side.

Opis:

The aim of the course on this topic is to present the process of approximation of national civil procedures in Europe, the process which has been considered since the 1980s and somehow is still on the agenda, but in many respects in a mature stage. Following the example of the ALI/UNIDROIT Principles of Transnational Civil Procedure, in 2013, the European Law Institute (ELI) and UNIDROIT launched a join project aiming to develop Europeans Rules of Civil Procedure based on the ALI/UNIDROIT Principles. During over the seven years of hard work, around fifty international experts from Europe and beyond drafted the ELI/UNIDROIT Model European Rules of Civil Procedure, formally approved by the relevant bodies of the ELI and UNIDROIT in 2020, and published by Oxford University Press in 2021. Specifically, the aim of these classes will be for students to familiarize themselves with the architecture and development of the project, its methodological framework, key questions and dilemmas that arose during the course of work (e.g. model rules or model code, etc.). The general overview on the scope of the Model Rules and its structure will be presented. The general provision of the Model Rules will be particularly addressed as well as some selected parts of the Rules.
